These Terms and Conditions apply to the use of boxsplit.co and to purchases made through the website.

By using our website or placing an order with us, you agree to be bound by these Terms and Conditions.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

2. Eligibility

By placing an order with us, you confirm that:

  • You are at least 18 years old.

  • You are legally capable of entering into a binding contract.

  • The information you provide is accurate and complete.

  • You are purchasing products for lawful purposes.

We reserve the right to refuse or cancel an order where we reasonably suspect fraud, misuse of the website or other unlawful activity.


3. Products

BoxSplit sells products which may include, but are not limited to:

  • Workwear

  • Casualwear

  • Activewear

  • Household supplies

  • Accessories

  • Promotional products

  • Other consumer goods

We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information displayed on our website are accurate.

Product images are for illustrative purposes only.

Colours and appearance may vary slightly due to lighting, photography, manufacturing variations and differences between computer, tablet and mobile device displays.

We reserve the right to change, replace or discontinue products at any time.

This will not affect orders that we have already accepted unless we contact you and agree an alternative arrangement.


4. Pricing

All prices are displayed in GBP (£).

Hymac-Direct Limited is not currently registered for VAT and VAT is not charged on our prices.

Any applicable delivery charges will be displayed separately before you complete your order.

We may change our prices at any time, but price changes will not affect orders that we have already accepted.

If we discover an obvious pricing or product-description error after you place an order, we may contact you to give you the option of proceeding at the correct price or cancelling the order for a full refund.


5. Orders and Contract Formation

When you place an order, you will normally receive an email confirming that we have received your order.

This acknowledgement does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we confirm acceptance of your order or dispatch the goods to you.

We may refuse or cancel an order where there is a legitimate reason to do so, including where:

  • The product is unavailable.

  • Payment has not been authorised.

  • We identify an obvious pricing or description error.

  • We reasonably suspect fraud or unlawful activity.

  • We are unable to deliver to the address supplied.

  • You have materially breached these Terms and Conditions.

If we cancel an order after payment has been taken, we will refund the relevant amount where you are entitled to a refund.


6. Payment

Payment must be made using one of the payment methods available during checkout.

Payments may be processed by third-party payment providers.

We do not directly store your full payment card details where those details are securely processed by our payment provider.

You are responsible for ensuring that the payment information supplied is accurate and that you are authorised to use the selected payment method.


7. Delivery

Available delivery options, charges and estimated delivery times will be displayed during checkout where applicable.

Unless a different delivery period has been agreed with you, goods will normally be delivered without undue delay and no later than 30 days after the contract is entered into.

Delivery dates and times provided by us are estimates unless we have expressly agreed that delivery by a particular date is essential.

We are not responsible for delays caused by circumstances outside our reasonable control.

These may include:

  • Courier or postal delays.

  • Severe weather.

  • Transport disruption.

  • Customs delays.

  • Industrial action.

  • Natural disasters.

  • Government action.

  • Other circumstances outside our reasonable control.

If a substantial delay occurs, we will contact you where reasonably possible.

Risk of loss or damage to the goods passes to you when the goods are delivered to you or to a person identified by you to receive them.


8. Third-Party Supplier Fulfilment

Some products sold through BoxSplit are stocked, fulfilled and/or dispatched directly to you by our third-party suppliers, manufacturers, distributors or fulfilment partners.

This means that some goods purchased from BoxSplit may be delivered directly from one of our suppliers rather than being dispatched from our own premises.

Where an order is fulfilled or dispatched by a third-party supplier, your purchase remains a contract with Hymac-Direct Limited, trading as BoxSplit, unless we expressly tell you otherwise before you place your order.

The use of a third-party supplier to fulfil or dispatch an order does not affect your statutory consumer rights.

To enable our suppliers or fulfilment partners to process and dispatch your order, we may provide them with information reasonably necessary to fulfil the order, including:

  • Your name.

  • Delivery address.

  • Contact details.

  • Products ordered.

  • Other information reasonably required to complete delivery.

Personal information will be handled in accordance with our Privacy Policy and applicable UK data protection law.

Separate Deliveries

Orders containing multiple products may be supplied by different suppliers.

As a result:

  • Products from the same order may arrive separately.

  • Products may arrive on different days.

  • Different couriers may be used.

  • You may receive more than one parcel for a single order.

You will not normally be charged additional delivery fees because we have chosen to split an order into multiple deliveries unless this was clearly disclosed and agreed before you placed your order.

Supplier Packaging

Goods dispatched directly from a supplier may arrive in packaging supplied by that supplier, manufacturer, distributor or fulfilment partner.

Delivery labels, packaging or documentation included with an order may therefore contain the name or details of the supplier or fulfilment partner responsible for dispatching the goods.

Delivery Times

Delivery times may vary depending on the product, supplier, availability and delivery destination.

Where reasonably possible, estimated delivery information will be displayed on our website or provided during the ordering process.

Problems With Supplier-Fulfilled Orders

If there is a problem with an order, including goods that are:

  • Faulty.

  • Damaged.

  • Incorrect.

  • Missing.

  • Not as described.

  • Not received.

you should contact BoxSplit at info@hymac-direct.com.

Unless we specifically instruct you otherwise, you should deal with BoxSplit rather than contacting the third-party supplier directly.

Nothing in this section limits or excludes any rights available to consumers under applicable UK consumer law.


9. Your Right to Cancel Online Orders

For most goods purchased online, consumers have the legal right to cancel their order without giving a reason.

You normally have 14 days from the day after you receive the goods to tell us that you wish to cancel.

After notifying us that you wish to cancel, you normally have a further 14 days to return the goods.

You may also use the Model Cancellation Form provided at the end of these Terms and Conditions, although you are not required to use that form.

Returning Cancelled Orders

Unless we agree otherwise, you are responsible for the direct cost of returning unwanted goods.

You may inspect and handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, similar to what would normally be permitted in a shop.

If goods have been handled beyond what is reasonably necessary and their value has been reduced as a result, we may make an appropriate deduction from the refund where permitted by law.

You do not necessarily have to return an item in its original outer delivery packaging to exercise your statutory cancellation rights.

We recommend that returned goods are securely packaged to prevent damage during return delivery.


10. Returns of Supplier-Fulfilled Products

Because some products are dispatched directly by third-party suppliers, the return address may be different from our registered office address.

Customers should contact BoxSplit before returning goods so that we can provide the appropriate return instructions and return address.

Do not automatically return goods to the address shown on the original delivery packaging unless we instruct you to do so.

Depending on the product, goods may need to be returned:

  • To BoxSplit.

  • Directly to the supplier.

  • To a manufacturer's returns centre.

  • To another designated returns facility.

Where you are responsible for the cost of returning unwanted goods, we will provide the appropriate return address or instructions.

Where goods are faulty, damaged, incorrect or otherwise do not conform to the contract, your statutory rights will apply.

The use of a supplier's return facility does not change the fact that your purchase was made from Hymac-Direct Limited, trading as BoxSplit.


11. Exceptions to the Right to Cancel

The statutory right to cancel may not apply to certain goods, including where applicable:

  • Goods made to your specifications.

  • Clearly personalised or customised goods.

  • Goods which are liable to deteriorate or expire rapidly.

  • Sealed goods which are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery.

  • Other goods or services excluded from cancellation rights under applicable law.

Any applicable exclusion will be made clear where reasonably possible before purchase.

This section does not affect your rights where goods are faulty, damaged, not as described or otherwise fail to comply with applicable consumer law.


12. Faulty, Damaged or Incorrect Goods

Goods supplied by us must be:

  • Of satisfactory quality.

  • Fit for their intended purpose where applicable.

  • As described.

If you receive goods which are faulty, damaged, not as described or incorrect, please contact us as soon as reasonably possible.

We recommend contacting us within 48 hours where goods have been damaged during delivery, as this can assist us in dealing with the courier or supplier.

However, failure to notify us within 48 hours does not remove or restrict your statutory consumer rights.

We may ask you to provide photographs or other reasonable evidence of the problem.

Depending on the circumstances and your statutory rights, you may be entitled to:

  • A repair.

  • A replacement.

  • A price reduction.

  • A refund.

Nothing in these Terms and Conditions limits your rights under the Consumer Rights Act 2015 or other applicable consumer legislation.


13. Refunds

Where you validly cancel an online order under your statutory cancellation rights, we will provide the refund required by law.

For returned goods, we may withhold the refund until:

  • We receive the goods back; or

  • You provide evidence that you have returned the goods,

whichever occurs first.

Refunds will normally be made within 14 days of the relevant date required by law.

Where applicable, we will also refund the cost of our least expensive standard delivery option.

If you selected a more expensive or premium delivery method, we are not required to refund the additional delivery cost above our standard delivery charge.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.


14. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may normally be used per order.

  • Discount codes may have expiry dates.

  • Codes may apply only to selected products.

  • Minimum order values may apply.

  • Promotional codes may be withdrawn where there is a legitimate reason to do so.

  • Codes obtained or used fraudulently may be cancelled.

Withdrawal of a promotion will not affect an order already accepted where the promotion was validly applied.


15. Intellectual Property

Unless otherwise stated, intellectual property rights in the BoxSplit website and content created by us, including:

  • Logos.

  • Branding.

  • Graphics.

  • Photographs.

  • Product descriptions.

  • Website design.

  • Text.

  • Marketing materials.

are owned by or licensed to Hymac-Direct Limited.

You may not reproduce, distribute, modify or commercially exploit our protected content without our prior written permission, except where permitted by law.

Third-party trademarks, photographs, product information and other intellectual property remain the property of their respective owners.


16. Website Use

You must not:

  • Use the website for unlawful or fraudulent purposes.

  • Attempt to gain unauthorised access to our systems.

  • Introduce viruses, malware or other malicious software.

  • Attempt to interfere with the operation or security of the website.

  • Use automated systems to misuse or overload the website.

  • Impersonate another person or business.

  • Use the website in a way that infringes the rights of another person.

  • Attempt to obtain unauthorised access to another customer's account.

We may restrict or suspend access where we reasonably believe these Terms have been seriously breached or where necessary to protect our website, customers or business.


17. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Your statutory rights relating to faulty, misdescribed or otherwise non-conforming goods.

  • Any other liability which cannot legally be excluded or limited.

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that are not reasonably foreseeable.

Products sold to consumers are supplied for private use unless otherwise agreed.

We are not responsible for business losses such as loss of profit, revenue, contracts, business opportunities or business interruption arising from consumer use of our products, except where the law provides otherwise.


18. Privacy and Data Protection

We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

Our Privacy Policy explains:

  • What personal information we collect.

  • Why we collect it.

  • How we use it.

  • Who we may share it with.

  • How long we retain it.

  • Your rights regarding your personal information.

  • How you can contact us regarding your information.

Because some orders are fulfilled by third-party suppliers, we may share information necessary to fulfil and deliver your order with suppliers, distributors, manufacturers, fulfilment partners and delivery companies.

We will only share information reasonably necessary for these purposes and in accordance with applicable data protection law.


19. Events Outside Our Reasonable Control

We are not responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.

Such circumstances may include:

  • Severe weather.

  • Natural disasters.

  • Industrial disputes.

  • Transport disruption.

  • Telecommunications failures.

  • Internet or technology failures outside our reasonable control.

  • Government action.

  • Courier disruption.

  • Other events which could not reasonably have been avoided.

This section does not affect any statutory rights you may have, including rights relating to delayed or failed delivery.


20. Governing Law and Disputes

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also have rights under the mandatory laws applicable where you live and may be entitled to bring proceedings in the courts applicable to your place of residence.

Nothing in these Terms is intended to restrict any rights you have regarding where legal proceedings may lawfully be brought.

We encourage customers to contact us first so that we can attempt to resolve any complaint or dispute.


21. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to:

  • Our business.

  • Our website.

  • Our products or services.

  • Applicable laws or regulations.

Changes will apply from the date the updated Terms are published.

Changes will not retrospectively alter the Terms applicable to an order already accepted unless required by law or agreed with you.

The latest version will always be available on our website together with its last updated date.

23. User Accounts

Certain features of the BoxSplit website may require you to create an account.

When creating or using an account, you agree to:

  • Provide accurate and current information.

  • Keep your details up to date.

  • Take reasonable steps to protect your login credentials.

  • Maintain the confidentiality of your password.

  • Notify us promptly if you believe your account has been accessed without permission.

You must not:

  • Deliberately provide false information.

  • Impersonate another person or organisation.

  • Access another person's account without permission.

  • Use your account for fraudulent, abusive or unlawful purposes.

We may temporarily suspend or terminate an account where we reasonably believe there has been fraud, unlawful activity, a material breach of these Terms or a security risk.


24. Account Security

You are responsible for taking reasonable steps to protect your account credentials.

We recommend that you:

  • Use a strong and unique password.

  • Do not share your password with anyone.

  • Log out when using a shared or public device.

  • Keep your contact information up to date.

If we detect suspicious activity, we may temporarily restrict an account while we investigate.

We may ask you to verify your identity before account access is restored.

Nothing in this section excludes or limits any liability that cannot legally be excluded.


25. Customer Reviews

Customers may be invited or permitted to leave reviews about products purchased from BoxSplit.

By submitting a review, you confirm that:

  • It reflects your genuine experience and opinion.

  • You have the right to submit the content.

  • It does not knowingly contain false or misleading information.

  • It does not infringe another person's intellectual property or other rights.

Reviews must not contain:

  • Unlawful material.

  • Threatening or abusive content.

  • Discriminatory content.

  • Defamatory statements.

  • Obscene material.

  • Personal information relating to another person without appropriate permission.

  • Spam or unrelated advertising.

  • Content that infringes copyright, trademarks or other intellectual property rights.

We may moderate or remove reviews where we reasonably believe they breach these rules or applicable law.

We will not remove or suppress a genuine review merely because it is negative.

Publication of a review does not mean that BoxSplit endorses or agrees with the opinions expressed.


26. User-Generated Content

If you voluntarily submit photographs, videos, comments, testimonials, social media content or other material ("User Content") to BoxSplit for publication or promotional use, you retain ownership of your User Content.

By submitting User Content for those purposes, you grant Hymac-Direct Limited, trading as BoxSplit, a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, resize and adapt the content as reasonably necessary for:

  • Our website.

  • Our social media channels.

  • Email marketing.

  • Advertising.

  • Promotional materials.

  • Other BoxSplit marketing communications.

You confirm that:

  • You own the content or have permission to submit it.

  • You have the necessary rights to allow us to use it.

  • The content does not unlawfully infringe another person's rights.

  • The content is lawful.

Where User Content identifies other people, you are responsible for ensuring you have any permission reasonably required to submit it.

We may decline to publish or may remove User Content where we reasonably consider it unlawful, offensive, misleading, infringing or otherwise inappropriate.

Our use of personal information contained within User Content remains subject to our Privacy Policy and applicable data protection law.


27. Social Media Content

If you tag BoxSplit, mention our brand or use a BoxSplit campaign hashtag, this alone does not automatically give us permission to use your content for advertising or marketing purposes.

We may contact you to request permission to repost or otherwise use your content.

Where you give permission, you retain ownership of your content and grant us the licence described in Section 26, subject to any additional terms agreed with you.


28. Statutory Rights

Nothing contained in these Terms and Conditions is intended to exclude, restrict or replace any rights available to consumers under applicable UK law.

If there is any conflict between these Terms and rights which cannot legally be excluded or restricted, your statutory rights will apply.
